Patent Registration Oman

One of the main services we provide to companies is the filing of patent applications and rights protection. This includes registering ownership of patents and intellectual property, assessment of IT assets in connection with acquisitions, strategic alliances and other business partnership relationships.

Patents law issued by Royal Decree No. 67/2008 dated 4/5/2008, and becomes effective after published in Official Gazette No. 863 issued 18/5/2008.

  • After an application for the grant patent is filed, it is examined with respect to compliance with formalities and patent ability provided for under the Patent Law including the novelty, inventiveness and industrial application and if the application is completed with the requirements, the Registrar will publish it in Official Gazette.
  • Within one hundred twenty (120) days from the publication in the Official Gazette of the notice of the request for substantive examination any interested party may file with the Registrar information relevant to patentability as well as relevant evidence.
  • Where the Registrar is of the opinion that the application complies with all the conditions, a patent shall be granted. Otherwise, the application shall be refused and the applicant shall be notified.
  • Period of protection of a Patent: 20 years.
  • Claim priority according to Paris Convention within 12 months from the first filing date.
  • For international patent, application in Oman should be filed within 30 months from the date of filing the priority application.
    • A Power of Attorney notarized and legalized by the Consulate of Oman or Apostilled if the applicant’s country is a member of Apostille Convention.
    • A certified (or notarized) copy of the Certificate of Incorporation of the applicant (with Arabic translation).
    • A certified copy of the priority document.
    • A legalized copy of the Deed of Assignment from the inventor(s), with Arabic translation or Apostilled if the applicant’s country is a member of Apostille Convention..
    • Abstract of the invention in English and Arabic.
    • Technical specification of the invention in English & Arabic
    • Copy of the PCT publication, with Arabic translation if it is published.

    According to Omani Law it must be submitted these documents immediately with the filing application:

    • Abstract of the invention in English and Arabic.
    • Technical specification of the invention in English.
    • Copy of the PCT publication,
    • A certified copy of the priority document.

    The Omani Law gives two months from the filing date to submit the Power of Attorney.

    Three months from filing date to submit these documents:

    • A certified (or notarized) copy of the Certificate of Incorporation of the applicant (with Arabic translation)
    • A legalized copy of the Deed of Assignment from the inventor(s), with Arabic translation.
    • Technical specification of the invention in Arabic

    Annuity fees: Six months, with a fine must be paid on the anniversary date of the filing of the patent with a grace period of three months without a fine extendable by another three months with a fine. The payment of annuities must be paid before the due date at any time and for any number of years.
