Industrial Design
As for our services for the protection of designs, we offer you assistance in registering an industrial design – if it is new. We assist you in submitting the application and preparing all requirements until receiving the registration certificate.
An industrial design will be registered if it is new. It’s considered as new if it does not significantly differ from designs that have been disclosed to the public, anywhere in the world, by publication in tangible form or by use or in any other way, prior to the filing date or, where applicable. The priority date of the application for registration (“known designs”) or from combinations of features of known designs. Industrial designs that are contrary to public order or morality shall not be registered.
The registration of an industrial design shall be for a period of five years from the filing date of the application for registration. At the owner’s request, and as per the Regulations, and after payment of the prescribed fees, the registration shall be renewed for two further consecutive periods of five years.
A grace period of six months shall be allowed for the late payment of the renewal fee on payment of the prescribed surcharge, otherwise the registered industrial design shall lapse. There shall be no restoration of lapsed registered industrial designs.
- Particulars of the owner, such as name, address, nationality and nature of business.
- Power of Attorney legalised by the Omani Consulate or Apostilled if the applicant’s country is a member of Apostille Convention..
- The title and drawings of the design showing the elements of novelty, supported by brief description.
- Certified copy of the commercial register or any equivalent document.
- Particulars of corresponding foreign registration(s), if any.
- Power of Attorney from the assignee notarized and legalized by the Consulate of Oman or Apostilled if the applicant’s country is a member of Apostille Convention..
- A certified (or notarized) copy of the Certificate of Incorporation of the assignee (with an Arabic translation).
- Deed of assignment executed by the parties, legalized by the Consulate of Oman or Apostilled if the applicant’s country is a member of Apostille Convention.
- Power of Attorney legalised by the Omani Consulate or Apostilled if the applicant’s country is a member of Apostille Convention..
- Merger agreement document signed by both parties, legalised by the Omani Consulate or Apostilled if the applicant’s country is a member of Apostille Convention..
- Power of Attorney reflecting the new name or address legalised by the Omani Consulate or Apostilled if the applicant’s country is a member of Apostille Convention.
- Certificate of Incorporation or extract from the commercial register reflecting the change, legalised by the Omani Consulate or Apostille.
- Power of Attorney signed by the licensee, legalised by the Omani Consulate
- License agreement document signed by both parties, legalised by the Omani Consulate.
